Today, nearly 200 million Americans use cell phones. As that number continues to grow, so too does the number of Americans that use cell phones while driving. That means more people are taking their eyes off the road to pick up their cell phones, dial phone numbers and answer calls.

This has become a mounting cause of concern for governments, insurance groups and citizens alike. In Europe, drivers have long been forbidden to operate a vehicle and a cell phone simultaneously. The fines for violating these rules are prohibitive and drivers run the risk of losing their license.

In the U.S., we too are seeing legislation move towards cell phone restrictions when operating a motor vehicle. New York was the first state to ban cell phone use by drivers. They were followed quickly by New Jersey, Connecticut and Washington D.C. In the last year, Colorado, Delaware, Maryland and Tennessee have all banned young people from cell phone use while driving. Chicago has also banned the use of hand held cell phones while driving, imposing penalties of $50 or $200 if the driver is involved in an accident. Others are following suit and in the beginning of 2005 alone, more than two-thirds of states considered legislation that would restrict the use of cell phones while driving.

In addition to cities and states, many businesses are also banning employees from using cell phones while driving. This is in large part due to recent civil court decisions that have held employers liable for accidents involving their employees who were conducting business on cell phones. In one such case, an employer was required to pay the plaintiff $5 million.
